VZW BEYOND exploiting Planet Happiness processes personal data as indicated in this Privacy Policy. VZW BEYOND attaches great importance to the protection of the personal data it processes, and therefore takes appropriate measures to prevent misuse, loss, unauthorised access, unwanted disclosure and unauthorised modification.

This Privacy Policy contains information on how VZW BEYOND may process personal data, and how VZW BEYOND protects these data.

This Privacy Policy complies with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter “the Regulation”).

This Privacy Policy applies to the website www.planethappiness.be, as well as the services offered by VZW BEYOND through these or other channels, and to all persons using them.

VZW BEYOND AS DATA CONTROLLER

VZW BEYOND may collect and process personal data of visitors to its website www.planethappiness.be.

When you visit the website www.planethappiness.be, we may use cookies and similar technologies (such as pixels, web beacons and local storage) to collect information about your use of our website and to provide you with certain functionality. VZW BEYOND AS DATA PROCESSOR

In the context of its activities, VZW BEYOND may act as a data processor of personal data on behalf of the Customer. When applicable, the Customer determines the purpose and means of the processing, and the Customer is the data controller of the personal data within the meaning of the Regulation. In that case, VZW BEYOND is merely a data processor within the meaning of the Regulation. VZW BEYOND does not vouch vis-à-vis the person concerned for the lawfulness of the processing of their personal data.

VZW BEYOND cannot and will not respond to queries relating to personal data of which VZW BEYOND is not the data controller.

SECURITY PERSONAL DATA

VZW BEYOND takes appropriate technical and organisational measures to secure personal data against unauthorised or unlawful processing and against accidental loss, destruction or damage. 

VZW BEYOND ensures, as far as technically possible, the integrity, availability and confidentiality of personal data, through the use of security technologies and techniques. Activities involving personal data are recorded in log files. The same applies to other relevant events, such as attempts to gain unauthorised access to personal data and disruptions that may result in the alteration or loss of personal data.

VZW BEYOND utilizes Mailchimp, a service provided by a US-based company, for managing our mailing lists. As Mailchimp is based in the United States, your personal data may be transferred outside the European Union. The European Commission and the United States have recently reached an adequacy decision, recognizing that the United States ensures an adequate level of protection for personal data transferred from the EU to US-based companies under the new framework (see Adequacy decision for the EU-US Data Privacy Framework (DPF) of the European Commission of 10 July 2023). Therefore, personal data can be safely transferred from the EU to US-based companies, including Mailchimp, in accordance with this adequacy decision. Parties previously certified under the EU-US Privacy Shield Framework and committed to upholding the DPF Principles may now rely on this adequacy decision to transfer data from the EU to the US. Mailchimp is one such company and will continue to protect EEA data in compliance with its certification obligations.

VZW BEYOND cannot be held liable in any way for unauthorised or unlawful processing or accidental loss, destruction or damage of personal data, as a result of careless handling by the user or Customer of logins and/or passwords.  

DETAILS ABOUT THE PROCESSING OP PERSONAL DATA

ARTICLE 1 – PERSONAL DATA

1.1 VZW BEYOND collects personal data when you voluntarily provide such information to us, including but not limited to, when you register for access to the website, purchase a ticket without registering through our websites and/or apps, contact us with inquiries, respond to one of our surveys or browse or use certain parts of the website.

1.2 Personal data that you provide to us are (without limitation): name and first name, e-mail and phone number. VZW BEYOND also collects anonymous demographic information, which is not unique to you, such as your zip code, age, gender, preferences, interests and favorites.
VZW BEYOND may also ask, for those cases where a user decides to create its own event, information regarding business name, VAT number, or business address, among others, that may also constitute personal data.

1.3 There is also information about your computer hardware and software that is automatically collected by VZW BEYOND. This information may include (without limitation): your IP address, browser type, domain names, access time and website addresses. This information is used by VZW BEYOND to perform the service optimally, to maintain the quality of the service and to provide general statistics regarding the use of the Planet Happiness website.
VZW BEYOND may receive personal data about you from various third parties if you log into the website through a third-party account such as Facebook or Google, we will collect certain information relating to your account with those third parties (including your name, profile image, age group, gender and other information available on your public profile), your date of birth and your e-mail address. You can manage the information data which is shared by such third parties with us by amending your preferences through using the privacy settings which these third parties provide on their platforms.

1.5 VZW BEYOND may collect your email address, name, and surname to facilitate the operation and enhancement of our photobooth services. Your email address may be used to send you important updates, confirmations, or notifications regarding your photobooth experience. Additionally, we may use this information for future mailing lists and promotional purposes, such as sending you newsletters, special offers, or information about upcoming events. By using the photobooth and providing your email address, you consent to the use of your information for these purposes.

ARTICLE 2: PURPOSES OF THE PROCESSING OF YOUR PERSONAL DATA

2.1 General purposes
VZW BEYOND collects and uses your personal data to manage the Planet Happiness website and to provide the services you have requested. VZW BEYOND also uses your personally identifiable information to inform you of other products or services available from Planet Happiness and its affiliates. VZW BEYOND may also contact you through surveys to investigate your views on current services or any new services to be offered.

2.2 VZW BEYOND tracks which pages our customers visit on the Planet Happiness website to determine which Planet Happiness services are the most popular. This data is used for tailored satisfaction and to advertise within Planet Happiness to customers whose behavior indicates that they are interested in a specific area.

2.3 Direct marketing
The personal data will not be used for direct marketing, unless you have given additional explicit permission for this (“opt-in”). This permission can be withdrawn at any time, without motivation and free of charge, by sending an email to hello@planethappiness.be.

2.4 Transfer to third parties
The personal data will not be passed on to third parties, unless you have given additional express permission for this (“opt-in”). This permission can be withdrawn at any time, without motivation and free of charge, by sending an email to hello@planethappiness.be.

2.5 VZW BEYOND does not sell, rent or lease its customer lists to third parties
VZW BEYOND may, from time to time, contact you on behalf of external business partners about a particular offering that may be of interest to you. In those cases, your personal data (e-mail, name, address, telephone number) will not be passed on to third parties. In addition, VZW BEYOND may share data with trusted partners to help us perform statistical analysis, send you email or postal mail, provide customer support, or arrange for deliveries. All such third parties are prohibited from using your personal information except to provide these services to VZW BEYOND, and they are required to maintain the confidentiality of your information.

2.6 Other purposes
We process your personal data for the following purposes:
     1. It is necessary to fulfill a contract that we have with you.
     2. It is required for our legitimate interests.
     3. It is necessary for us to comply with our legal obligations.
     4. It is permitted because you have provided your consent to us.
If we are required to collect personal data by law or under the terms of a contract we have with you, and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you. In such cases, where we cannot provide you with the services, we will notify you promptly.

ARTICLE 3: DURATION OF THE PROCESSING

3.1 The personal data is stored and processed by us for a period that is necessary in function of the purposes of the processing and in function of the contractual relationship between VZW BEYOND and you.

ARTICLE 4: YOUR RIGHTS

4.1 Right of access and inspection
You have the right to access your personal data at any time, as well as the use we make of your personal data.

4.2 Right of correction and removal
You are free to choose whether or not to communicate your personal data to Planet Happiness. In addition, you always have the right to request us to correct, supplement or delete your personal data. You acknowledge that in the event of refusal to notify or request the removal of personal data, certain services and products will not be available.
It may take up to 48 hours for us to process a request to delete your personal data. Even after a removal request, it may be possible that some of your personal data retains in accordance with this privacy policy and applicable laws in order to comply with our information removal obligations. 

4.3 Right to object
You also have a right to object to the processing of your personal data for serious and legitimate reasons. However, you cannot object to the processing of your personal data if this is necessary for the performance of the contractual obligations. In addition, you always have the right to object to the use of personal data for direct marketing purposes.

4.4 Exercise of your rights
You can exercise your rights by contacting us for this purpose, in writing by sending an e-mail to hello@planethappiness.be, provided that you enclose a copy of your identity card.
We will provide our response within a reasonable period (and in any event within any time period required by applicable law). Please note, however, that certain personal data may be exempt from such requests in certain circumstances.

COMPLAINTS

You always have the right to turn to the Belgian Data Protection Authority for complaints regarding the processing of your personal data.
